TERMS AND CONDITIONS OF SERVICE

1. PURPOSE AND ACCEPTANCE

This contract regulates the provision of Virtual Private Server (VPS) services provided by VPSFree.es (hereinafter, 'the Provider'). By hiring and activating a service, the user (hereinafter, 'the Client') accepts these terms without reservation.

2. NATURE OF THE INFRASTRUCTURE

The Client acknowledges and accepts that VPSFree operates through its own independent infrastructure (Homelab). By its nature, the service is subject to the technical limitations of the local power supply, uninterruptible power supplies (UPS), and the connectivity of the Provider's internet service provider (ISP).

3. AVAILABILITY AND LIMITATION OF LIABILITY

1. Continuity of Service: VPSFree does not guarantee a minimum uptime (SLA). The service may be interrupted by power outages, network line failures, hardware failures, or maintenance tasks.

2. Disclaimer: The Provider shall not be liable for any loss of data, loss of profits, or damages resulting from the unavailability of the service caused by external factors, technical failures, or force majeure.

3. Maintenance: The Provider reserves the right to carry out scheduled technical stops to guarantee hardware integrity, attempting to provide advance notice whenever possible.

4. PAYMENT AND REFUND POLICY

1. Right of Withdrawal: In accordance with Art. 103.a) of Law 1/2007 (Spain), as it is a digital service whose execution begins immediately after payment, the Client accepts that they lose their right of withdrawal.

2. No Refunds: No refunds will be made to the original payment method (card, PayPal, cryptocurrencies, etc.) once the service has been activated.

3. Credit: In exceptional situations evaluated by the Provider, compensation may be issued exclusively in the form of internal credit on the platform, not exchangeable for cash.

4. Billing Cycle and Deletion: The system will notify the invoice 10 days before its due date. If not paid by the due date, the service will be suspended. After 2 calendar days of non-payment (48 hours after expiration), the final and irreversible deletion of the server data will proceed to free up resources, with no possibility of recovery.

5. DISPUTES, CLAIMS AND BANK FRAUD

1. Amicable Resolution: Before opening any dispute in payment gateways (PayPal, Stripe, etc.), the Client is obliged to contact support at [email protected].

2. Dispute Management Fees: Opening a dispute or chargeback without justified cause or after having enjoyed the service will be considered fraud. In such case, an invoice of €30.00 will be issued for administrative expenses.

3. Suspension due to Dispute: Receiving a dispute notification will result in the immediate and permanent suspension of all the Client's services and the deletion of their data.

6. ACCEPTABLE USE POLICY (AUP)

The following is strictly prohibited and will cause immediate termination without right to compensation:

  • Spam: Sending unsolicited bulk emails. The Client will be responsible for any IP that results in blacklists.
  • Malicious Activities: DDoS attacks (launching or receiving), port scanning, phishing, or malware distribution.
  • Mining: Intensive use of CPU/GPU for cryptocurrency mining.
  • Illegal Content: Hosting material that violates the laws in force in Spain and the European Union.
  • Network Abuse: Excessive use that compromises the stability of the Provider's node or fiber optics.

7. SECURITY AND BACKUPS

1. Client Responsibility: The Client is solely responsible for the security of their operating system and applications.

2. Backups: VPSFree does not perform backups of client data. It is the Client's obligation to maintain their own external backups. The Provider is not responsible for the loss of information under any circumstances.

8. MINORS

Contracting by minors is allowed as long as they have the supervision and express authorization of their parents or legal guardians. VPSFree is not responsible for the use that the minor makes of the contracted resources.

9. TECHNICAL SUPPORT AND COMMUNICATIONS

Support is limited exclusively to infrastructure incidents (network and hardware). The Provider does not offer support for the configuration of software or applications installed by the client.

10. JURISDICTION

For any controversy, the parties submit to current Spanish legislation.
